8.2 Identification of AI-Powered Calls

Repen requires its business clients to comply with all applicable laws and regulations regarding disclosure of automated and AI-powered calling, including but not limited to:

  • Identifying when a call is made using AI or automated technology

  • Disclosing the identity of the business on whose behalf the call is being made

  • Honoring opt-out requests promptly

  • Obtaining required consents prior to initiating calls

8.3 Your Rights Regarding AI-Powered Calls

If you receive an AI-powered or automated call facilitated through the Repen platform, you have the following rights:

Right to Opt Out: You may opt out of receiving future calls at any time. To opt out, you can:

  • Say "stop," "unsubscribe," or similar opt-out language during the call

  • Press the designated opt-out key if prompted

  • Contact the business that called you directly

  • Contact Repen at legal@repen.co to report unwanted calls

Right to Know: You have the right to know if you are speaking with an AI-powered system rather than a live human agent.

Right to Speak with a Human: Depending on the business and purpose of the call, you may request to speak with a live human representative.

8.4 Compliance with Applicable Laws

Repen and its business clients are required to comply with all applicable federal, state, and local laws governing automated and AI-powered calling, including but not limited to:

  • The Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227

  • The FTC's Telemarketing Sales Rule (TSR)

  • State-specific telemarketing and robocall laws

  • Applicable regulations issued by the Federal Communications Commission (FCC)

Repen maintains policies and procedures to promote compliance with these laws and requires its business clients to represent that they have obtained all necessary consents before using our platform to contact individuals.

8.5 Reporting Unwanted Calls

8.6 For Repen Business Clients

If you are a business using the Repen platform to conduct AI-powered calling campaigns, you acknowledge and agree that:

(a) You are solely responsible for obtaining all required consents from individuals you contact through the platform;

(b) You will comply with all applicable laws and regulations governing automated and AI-powered calling;

(c) You will accurately identify yourself and the purpose of calls made through the platform;

(d) You will honor all opt-out requests promptly;

(e) You will not use the platform to conduct unlawful calling campaigns;

(f) You will indemnify Repen for any claims arising from your failure to comply with applicable laws.
